Terms & Conditions
It is the responsibility of the purchaser to review all measurements, intended product options, specifications and any details pertaining to their order to be sure the order is accurate and as intended. Once the invoice and product specification sheet is accepted by the purchaser, Black Label Home ( BLH ) is not responsible for production details that are not clearly agreed to and clearly noted on the order spec sheet and the sales invoice. Measurements may vary slightly due to the custom nature of our production. We allow up to 1.5″ finished variance per item ( per side if item is a sectional). Please consider this variance in your order process.
Cancellations or Changes
Due to the custom nature of our business, cancellations or changes will only be accepted within 4 business days of the order. A deposit of 50% is required at the time of order and will not be refunded should the purchaser wish to cancel after this period. Any changes considered after this period, is at the sole agreement of BLH and without obligation. No refunds will be issued due to items not fitting though access areas or into the residence.
Balance Payments
All orders must be paid upon completion, prior to the order being picked up by the delivery agent. No COD orders are accepted.
Fabric Delays
Occasionally fabrics are backordered without our vendors notifying us. We have no control over this occurrance. We will however, verify fabric availability at the time of order and notify the purchaser within 3 business days if there are any availability issues known at that time. If the pattern is not available, the purchaser may re-select or cancel their order for a full refund. BLH has no control over fabric delays of any kind. We can only use the information given us from our vendors and relay it to the purchaser in a timely way, which we agree to do.
Damaged Goods
In the event that goods arrive damaged, it is the responsibility of the purchaser to note said damage on the delivery copy. All damage must be reported to the freight company contracted with and pictures submitted to show the damage. Failure to notify your carrier may jeopardize your ability to be compensated for the damage. BLH is not responsible for freight damage.
Access It is the sole responsibility of the purchaser to make sure the items ordered will fit through all access areas leading to the residence and areas leading to the final room where it will be placed. No refunds or adjustments will be issued for items not fitting into the residence.
Warranty
Frame & Springs
Our frame and suspension system is warranted to be free of defects due to faulty materials or workmanship for the lifetime of the product under normal residential care and use. This warranty is only valid to the original owner as long as the furniture is upholstered in its original fabric. For slipcovered furniture, this is the fabric that covers the base of the piece.
Fabrics
Fabrics are traditionally NOT guaranteed against wear, fading or shrinking because fabrics are used in various settings. Black Label Home (BLH) offers a limited warranty on all of our fabrics. Fabrics are warranted for a period of six months against defective material or workmanship as well as unusual wear resulting from normal residential use and care. This warranty does not cover COM, wear, fading, shrinkage, fabric slubs which are normal in woven fabric construction, stretching which can occur with normal use of most fabrics, or dye transfer. Some fabrics like velvets or chenilles which have a nap will naturally wear or mark after use. These nuances are a characteristic of the fabric and are not considered a flaw or defect. If you choose to have fabric protection or other chemical treatments applied to your purchase, most have their own warranty, which will replace and void this warranty. Applied dealer or consumer aftermarket fabric treatment of any kind voids all mill and BLH warranties. Fabric damage or failure due to heavy soiling or improper cleaning are not covered. Cushion and pillow covers should never be machine washed except for slipcovered styles, and then only if the fabric was pre-washed, as the covers may shrink and seam integrity may be affected. BLH will not be responsible for damage due to machine washing of covers.
Seat Cushions
Foam core technology has dramatically improved over the last few years, and we feel that cushioning is really where comfort and longevity come from. Thus, we warrant all cushion cores not to collapse for the lifetime of the product as originally upholstered under normal residential care and use. All foams and filling materials will soften and conform to the shape of the users; this is considered normal and is not a defect. Please note that all seat cushions and back pillows “must” be maintained on a regular basis to promote appearance and even wear. Please refer to our section titled cushion and pillow care more information.
Seams
Seams are reinforced by using the latest technology in sewing. Any defects in workmanship should appear within the six months of usage. Therefore, we are confident to warrant our seams to be free of defects due to faulty workmanship (seam slippage), for a period of six months under normal residential care and use.
Additional Terms
Products in which any of the defects described in these warranties occur will be repaired or replaced at our option. If repair or replacement is not practical, at the option of BLH, alternate financial remuneration may be paid or the product may be substituted. This remedy is exclusive and BLH does not authorize any person to create for it any other obligation or liability in connection with this product. If a product is found defective under the warranty provisions all repair work will be performed by BLH at no charge to the original purchaser, exclusive of shipping or delivery costs necessary to affect the repair or replacement. During the the warranty period, the original purchaser is solely responsible for any shipping or delivery costs incurred to affect the repair or replacement. This warranty is rendered inapplicable if the product in question is subjected to misuse, alteration, fire, improper cleaning, negligence of reasonable maintenace or accidents.
Please Note
Customer assumes all freight charges to / from BLH . In the event of transit damage, please contact your contracted freight carrier within 48 hrs. upon receipt. Failure to provide immediate notification may jeopardize your ability to be compensated for the damage.This Limited Warranty applies under conditions of normal residential usage only and does not apply to defects or damage resulting from (a) negligence, abuse, or misuse; (b) inadequate or improper maintenance, cleaning, or care; (c) exposure to chemicals and/or liquids; (d) accidents; (e) any use for which the product was not designed. Damages that occur while moving to another residence are excluded. This Limited Warranty applies only when you purchase the BLH products from an Authorized Dealer for your own use and terminates in the event of resale. This Limited Warranty gives you specific legal rights and you may have other rights, which vary from state to state. TO THE EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED. BLH SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES.
Making Sure It Fits
Consider your entry options
Think about which door offers the easiest access for delivery. Consider garage and patio doors that may offer more clearance. For multi-unit buildings, find out if you have access to a service entrance.
Doorways and Hallways
Measure the width and height of your doorways and hallways, taking into account any handrails, doorknobs or trim that cannot be removed.
Elevators
Measure the height and width of the elevator door and the interior height, width and depth. Also take the diagonal measurement from the bottom center of the door opening to the back ceiling. Be aware of handrails and overhead lights in the elevator and include them in your measurements.
Clearing the Path
Consider removing these common obstacles before delivery or include them in your measurements if they cannot be removed: light fixtures, handrails, wall art or decorative items, fire extinguishers and sprinklers, and angled or low ceilings.
Stairways
Start by measuring the width of your stairway. Include handrails in your measurements if they cannot be removed. Next, measure your stairway ceiling height in three locations: 1) from the bottom step to the ceiling 2) from any landings to the ceiling and 3) from the top step to the ceiling. Finally, measure the width and depth of any landings. If the top or bottom of your stairway leads into a wall instead of an open space, measure the distance from the stairs to the wall.
Arranging your Furniture
Keep in mind how much access you’ll need to outlets, vents, light switches and thermostats in your room. Our Delivery Partner will place your new furniture exactly where you want it.
